Update 01/15/07 Well it seems that the rocket science that spells out copyright infringement seems to have taken effect. Yes, they were showing movies in the clubhouse and then after the MPAA found out that they were showing movies and charging for them. Too bad for them! They lost their movies, but if you are too cheap to go rent a movie, you can't get us sued to death by Hollywood for being stupid. Also, they some how tried to full a fast oneby maybe buying off an employee who got hurt maybe on the job. But now there is another alleged roof leak and they only have a few dollars in the roof fund. After all , why not just let it leak after you spent all the money on the wonderful mansard. And soon, the reign of Gilda Dinsmore comes to an end. But have they run background checks on any of the potential BOD members? Who knows? We will find out at their little meeting on Wed the 17th or at the Meet the Canidates Night. And tell me why they will nto audit the books after 21 years of operations. It really speaks of the possibility of fraud and mis-management. Of Course, the management company loves to do business with only a few companies who could be giving back pay-offs for the contracts issued to the poor condo owners. Now 7 smart owners are getting out because the possibility of a major assesment is around the corner because of the alleged illegalities that the same board of directors have pulled for the last 17 years. Not to mention that one of the BOD may be accused of the Unliscensed Practise of Law right now. And of course their attorney, the same attorney who goes after catholic priests who have crosses in their lawns,or goes after another poor woman who's husband if fighting in Iraq because she out a sign on here lawn to support the troops. Gee, what a guy! So there you have it, the BOD is almost out of here, the books are about to be audited by the State of Florida because of their lack of audits and of course all the digital photo's taken with date and time. Too bad for them!

UPDATE: 11/08/06:It seems that the nosy bastards at Otter Key have found out that I may have bought a new home on Snell Island. Yes you too can maybe come to Eden Isle Dr, N.E. if invited; and view the bay from the pool area or the dock. Too bad for them that they are trapped here and will more than likely die here. But they; the BOD had another so-called vote on the audit of the books. Now what they don't tell you is that the audit of the books is a tax deduction to the condo taxes as a not for profit corp. But they did not tell anyone that. But once again; as someone asked questions from the penthouse level about why the books have not been auditied, they had no answers except that that was the so-called vote. You can all  wonder what sort of financial mis-management may be going on with no audit of the books for 21 years. 21 years of never having to tell anyone where all the money has gone. Also it seems that they like to show movies in violation of the MPAA and now they charge as their own newsletter states.  Here is the exact laws that they are breaking and will cost all the residents of Otter Key major money if a lawsuit is filed by the MPAA agaist the condo for showing movies in a clubhouse and charging for the showing of the movie. The Federal Copyright Act (Title 17 of the U.S. Code) governs how copyrighted materials, such as movies, may be used. Neither the rental nor the purchase of a movie carries with it the right to show the movie outside the home. In some instances no license is required to view a movie, such as inside the home by family or social acquaintances and in certain narrowly defined face-to-face teaching activities. Taverns, restaurants, private clubs, prisons, lodges, factories, summer camps, public libraries, daycare facilities, parks and recreation departments, churches and non-classroom use at schools and universities are all examples of situations where a public performance license must be obtained. This legal requirement applies regardless of whether an admission fee is charged, whether the institution or organization is commercial or non-profit, or whether a federal or state agency is involved.

Legal Sanctions
"Willful" infringement for commercial or financial gain is a federal crime carrying a maximum sentence of up to five years in jail and/or a $250,000 fine. Civil damages for willful infringement may be as high as $150,000 per work, and even inadvertent infringers are subject to substantial civil damages, ranging from $750 to $30,000 for each work illegally shown. The MPAA and its member companies are dedicated to stopping film and video piracy in all its forms, including unauthorized public performances. The motion picture companies will go to court to ensure their copyrights are not violated. For example, lawsuits have been filed against cruise ships and bus companies for unauthorized on-board exhibitions.
If you are uncertain about your responsibilities under the copyright law, contact the MPAA, firms that handle public performance licenses or the studios directly. Avoid the possibility of punitive action.

They of course have been informed that they can't do this, but they don't care. So we let the MPAA know and provided them with pictures of the various films shown over the last 2 years through digital photography. Pictures don't lie! Why open up the residents with a hollywood lawsuit when you can go rent a movie yourself or through the cable? Gee where does the money go when they charge for the movie entrance fee?

Well the fact this that they are repairng the tennis courts, but are having a vote that will not let them spend money for an audit of the books; an audit of the books for the 21st year is about to happen on Nov 8th. They claim it will cost 7500  bucks for a a CPA. What they forgot to tell you is that one of the residents has offered to pay for the audit. In fact the same resident offered to pay for the audit of 2200 for the last years. How an audit goes from 2200 to 7500 in one year is very interesting do you think? 21 years of not auditing the books tells you something too don't you think?! It tells you that maybe something is wrong? The management company says that maybe the books will be audited over their corporate dead body? That is an allegation. But the are losing, and they know it. AND with over 140 power failures for since march 2005 also tells you something. Gee, Would you want to live here? 2 Board members have resigned in the last 9 months becuase of ???????????? Makes you wonder who is really making the money here? Could it be the managment company with gift contracts to their companies? Could it be the management company? Could it be the board members? No one knows because they will not let anyone near the books without a cop int he room. We haveexpereinced such things in person with lawyers as a witness of such actions
